Pixel Marmalade LLC (“we,” “us,” or “our”) operates InsureRoster (“the Service”). This page describes the rights available to Texas residents under the Texas Data Privacy and Security Act (TDPSA, Tex. Bus. & Com. Code § 541 et seq., effective July 1, 2024). This notice supplements our Privacy Policy.
1. Categories of Personal Data We Process
We process the following categories of personal data from or about Texas residents:
- Identifiers: Name, email address, phone number, IP address, and ZIP code submitted via lead forms.
- Professional information: Insurance license numbers, license types, license status, and business addresses sourced from government public records.
- Account credentials: Email address and hashed password for agents who claim their profile.
- Internet activity data: Browser type, referring URLs, pages visited, and server logs collected automatically for security and fraud prevention.
We do not process sensitive data as defined by the TDPSA (e.g., racial or ethnic origin, religious beliefs, health data, biometric data, or geolocation data).
2. Purpose of Processing
We process personal data for the following purposes:
- Directory services: Displaying publicly available insurance licensing data in a searchable directory.
- Lead delivery: Routing consumer-submitted inquiries to the appropriate licensed insurance professionals.
- Agent verification: Verifying that agents claiming profiles are the licensed professionals associated with those listings.
- Security and fraud prevention: Monitoring for abuse, enforcing rate limits, and protecting the integrity of the Service.
- Legal compliance: Complying with applicable laws, including TCPA, FCRA, and state privacy regulations.
3. Your Rights Under the TDPSA
As a Texas resident, you have the following rights regarding your personal data:
- Right to access: You may request confirmation of whether we are processing your personal data and obtain a copy of the data we hold about you.
- Right to correction: You may request that we correct inaccuracies in the personal data we hold about you.
- Right to deletion: You may request that we delete personal data you have provided to us or that we have collected about you, subject to certain exemptions (see Section 5 below).
- Right to data portability: Where technically feasible, you may request a copy of your personal data in a portable, readily usable format.
- Right to opt out: You may opt out of the processing of your personal data for purposes of targeted advertising, the sale of personal data, or profiling in furtherance of decisions that produce legal or similarly significant effects.
We do not sell personal data, engage in targeted advertising, or profile consumers for decisions producing legal or similarly significant effects.
4. How to Submit a Request
To exercise any of your rights under the TDPSA, submit a request using one of the following methods:
- Email: Send your request to [email protected] with “TDPSA Privacy Request” in the subject line. Include your full name and the email address or phone number associated with your interaction with InsureRoster so we can locate your records.
- Mail: Pixel Marmalade LLC, Attn: Privacy Requests, with the same identifying information described above.
We may need to verify your identity before processing your request. We will not require you to create an account to submit a request.
5. Response Timeframe
We will acknowledge your request and respond within 45 days of receipt. If we require additional time due to the complexity or volume of requests, we may extend the response period by an additional 45 days and will notify you of the extension and the reason for it.
If we decline to take action on your request, we will inform you of the reason within 45 days and provide instructions on how to appeal our decision (see Section 7 below).
6. Exemptions
Certain data processed by InsureRoster is exempt from TDPSA consumer rights requests:
- Government public records: Insurance licensing data — including agent names, license numbers, license status, and business addresses — is sourced from state regulatory agencies and is publicly available government data. This information is exempt from deletion and correction requests under the TDPSA. If you believe government-sourced data is inaccurate, please contact the issuing state regulatory agency directly, as they are the authoritative source of record.
- Suppression records: If you previously revoked consent, a hashed record of your phone number is retained on our suppression list to ensure we do not contact you again. This record is maintained for compliance purposes.
7. Appeal Process
If we decline your privacy request in whole or in part, you have the right to appeal our decision. To submit an appeal:
- Email [email protected] with “TDPSA Appeal” in the subject line.
- Include the date of your original request and the reason you believe the decision should be reconsidered.
We will respond to your appeal within 60 days. If we deny your appeal, we will provide you with information on how to contact the Texas Attorney General to submit a complaint. You may also contact the Texas Attorney General directly at texasattorneygeneral.gov.
8. Non-Discrimination
We will not discriminate against you for exercising your rights under the TDPSA. We will not deny you goods or services, charge you different prices or rates, or provide you with a different level or quality of service for exercising your privacy rights.
